Scope
Ctrl Cut Co (Pty) Ltd provides customised professional creative and production services.
Services cannot currently be purchased directly through https://ctrlcutstudio.co.za/.
This page explains CTRL CUT CO's general approach to deposits, cancellations and refunds.
The quotation, proposal, scope of work or service agreement applicable to a particular project may contain more specific terms and will govern that project.
1.1 Application of Terms and Applicable Law
Cancellation, refund and payment obligations are governed by the applicable project-specific agreement and relevant South African law, taking into account the nature of the client, the services provided and any statutory rights applicable to the transaction.
Where a project is cancelled, amounts payable or refundable will be assessed reasonably and proportionately, considering work performed, approved project stages, documented costs, third-party commitments and demonstrable losses arising from reserved production capacity, where recoverable under the applicable agreement and law.
The applicable quotation, scope of work and service agreement must be read together with this Policy.
Where terms differ, the project-specific agreement will prevail to the extent permitted by law.
Nothing in these arrangements excludes or restricts rights or remedies that cannot lawfully be waived or limited.
Deposit
Unless otherwise agreed in writing, CTRL CUT CO ordinarily requires a 50% deposit before production begins.
The deposit confirms the client's commitment to the project and enables CTRL CUT CO to reserve production capacity, allocate resources and commence the agreed preparation or production work.
The deposit forms part of the agreed project fee and is not an additional charge unless expressly stated otherwise in the applicable project agreement.
The amount, payment deadline and any project-specific deposit conditions will be set out in the applicable quotation, invoice or service agreement.
Any cancellation or refund involving the deposit will be assessed in accordance with the applicable agreement, work performed, reasonable commitments incurred and applicable law.
Cancellation before production begins
Where a client requests cancellation before production begins, CTRL CUT CO will assess the request in accordance with the applicable project agreement and relevant South African law.
Any reasonable cancellation charge or deduction may take into account work already performed, approved planning/ project management or preparation, third-party commitments, reserved production capacity and other demonstrable costs or losses directly associated with the project.
Any applicable charge will be assessed fairly and proportionately, taking into account the circumstances of the cancellation and any mandatory legal requirements.
Where payments received exceed the amounts lawfully payable following cancellation, the remaining balance will be refunded to the client.
Cancellation after production begins
Where a client cancels a project after production has commenced, CTRL CUT CO may be entitled to payment for work performed up to the effective cancellation date, together with reasonable and properly incurred project commitments, cancellation costs and other amounts recoverable under the applicable agreement and law.
These may include creative development, production work, allocated resources, approved third-party expenses and reasonable losses arising from reserved production capacity that cannot be recovered or reasonably mitigated.
The deposit may be applied towards amounts lawfully payable following cancellation.
Where the amounts payable exceed payments already received, an additional balance may remain due in accordance with the applicable agreement and law.
Where payments received exceed the amounts lawfully payable, the remaining balance will be refunded.
Cancellation charges and deductions will be assessed reasonably and proportionately, having regard to the applicable agreement, the circumstances of cancellation and any mandatory consumer-protection requirements.
Scope changes
A change in the project brief, cancellation of individual deliverables, reduction in required outputs or a decision not to use completed or partially completed work does not automatically create an entitlement to a refund.
Where the client requests changes to an approved scope, deliverable, creative direction or production stage, the request will be assessed in accordance with the applicable project agreement and change-control provisions.
Changes that fall outside the agreed scope or require the reopening of a previously approved production stage may result in additional fees, revised timelines or a formal rescope.
Any additional charges or revised commercial arrangements must be communicated and agreed before the affected additional work proceeds.
Nothing in this section limits any cancellation, refund or other remedy available under applicable law.
CTRL CUT CO cancellation
Where CTRL CUT CO is unable to provide agreed services, we will communicate the circumstances to the client as soon as reasonably practicable and seek an appropriate resolution.
Depending on the circumstances, this may include an agreed revised delivery arrangement, an alternative method of fulfilment, a partial refund or a full refund of amounts that are not lawfully retainable.
Where services have been partially performed, the treatment of completed work, outstanding deliverables and payments will be determined in accordance with the applicable project agreement and relevant law.
Where cancellation or non-performance arises from a breach or failure attributable to CTRL CUT CO, we will not impose cancellation charges that are inconsistent with the client's statutory or contractual rights.
Nothing in this section limits remedies available to clients under applicable South African law.
Statutory rights
Nothing in this policy is intended to waive or restrict any consumer right that cannot lawfully be waived or restricted under applicable South African law.
Cancellation and refund requests
Clients wishing to cancel a project or request a refund should notify CTRL CUT CO in writing using the contact details specified in their project agreement or by emailing info@ctrlcutstudio.co.za.
The request should identify the relevant project and explain the reason for cancellation or the refund being requested.
We will review the request against the applicable project agreement, the status of work performed, relevant project commitments and any applicable statutory rights.
Where appropriate, we will provide a written breakdown of amounts payable, deductions applied and any refund due.
Approved refunds will be processed using an agreed payment method within a reasonable period, subject to any specific timeframe required by applicable law.
Where a dispute arises, the parties may seek resolution through the procedures set out in the applicable project agreement or other remedies available under South African law.
